At about nine p.m. on a clear summer evening, plaintiffs car, driven by their son, overtook and struck the rear of defendants truck, which was stalled upon the highway. The lights on plaintiffs car were tilted down, and the driver says he could not see more than 40 feet ahead of the car. He was driving about 30 miles an hour and too fast, as he says, to avoid hitting the truck after he saw it. There were no existing conditions which prevented light from revealing the truck or which prevented the driver from avoiding it if seen. Under the circumstances, plaintiffs driver held guilty of contributory negligence as a matter of law.
